Privacy and Personal Data Protection Policy

  1. (Scope)

1.1. The Privacy and Personal Data Protection Policy aims to regulate the processing of personal data to be carried out by Lostflavour through the use of the website www.mavem.pt and the services available therein (hereinafter, the “Services”).

1.2. The collection and computer processing of personal data collected through the use of the website comply with Law No. 67/98, of October 26 ("Personal Data Protection Law").

1.3. By providing their personal data, the User expressly consents to their collection and processing under the terms defined in this Privacy Policy.

1.4. This Privacy Policy applies to any User, regardless of whether they have registered on the website or not.

Lostflavour, Unipessoal, LDA, with headquarters at Rua Santa Marinha, nº 6, 4585-813 Astromil, registered at the Commercial Registry Office of Paredes under the single registration number and NIPC 513 666 710, with a share capital of €30,000.00 (thirty thousand euros).

  1. (Data collected)

3.1 Data provided directly by the data subject;

3.2 Data collected within the scope of the relationship established with the data subject;

3.3 Personal data requested from the data subject processed with their consent;

  1. (Object)

The processing of personal data includes, namely, registration, collection, consultation, use, adaptation, alteration, storage, destruction, among other operations referred to in article 4, no. 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016.

  1. (Purposes)

The use of collected data has the following purposes, namely: 5.1 Processing of online orders, requests, inquiries or clarification of doubts to the data subject, through the website or applications;

5.2 Processing of requests for information about products, services, direct marketing communications, campaigns, promotions, statistical purposes and personalized content, subject to prior consent for this purpose;

5.3 Creating a personal account to be used for purchasing products through the website;

5.4 Processing of complaints, suggestions and customer complaints;

5.5 Carrying out profiles and analyzes on customer behavior;

5.6 Keeping customers informed about the latest products, offers, opportunities, via email, postal mail, SMS.

  1. (Legislation)

Lostflavour guarantees the processing of personal data in accordance with the legislation in force regarding its collection, processing, use, disclosure, storage and privacy.

  1. (Untreated data)

Lostflavour will not process personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, nor the processing of genetic data, biometric data, health-related data or data concerning the sexual life or sexual orientation of the data subject.

  1. (Registration)

By accessing or using our services and by participating in marketing activities promoted by Lostflavour, the user agrees to Lostflavour's privacy and personal data protection policy, giving their consent to its collection and processing for the purposes referred to in point 5, providing them directly and explicitly. Failure to provide or partial provision of personal data by the data subject may limit or prevent the provision of services, participation in events, campaigns or any other promotional and/or commercial activities or integration into recruitment processes.

  1. (Collection)

Personal data may only be collected in the event that:

9.1 The data subject purchases products online;

9.2 Contacts Lostflavour via email or phone;

9.3 Fills out a form;

9.4 Agrees to participate in marketing activities and/or campaigns and receive commercial information;

9.5 Registers on the Lostflavour website or at any commercial event, even if not automatically.

  1. (Consent to receive information)

The data subject will give their prior consent regarding the receipt of commercial communications for marketing purposes, being granted the right to object, at any time, by written communication addressed to Lostflavour. The said commercial information may be sent by Lostflavour, via email, telephone, SMS or any other electronic communication means, social media websites, Web 2.0, any mobile content or method.

  1. (Transmission)

In addition to the obligations referred to in the applicable data protection law or the safeguarding and protection of its own interests, Lostflavour will not share any personal data with third parties, with the exception of companies in its group, provided that the security and integrity conditions of the respective data are guaranteed.

  1. (Technical and organizational measures)

Lostflavour has adequate technical and organizational measures for the protection of processed data, namely, against unauthorized access or any other form of illegal or unlawful processing. Lostflavour guarantees, in addition to the security and internal protection measures of its facilities, the limitation of access to personal data only to its employees for the fulfillment of processing purposes.

  1. (Access, Alteration and Erasure)

The data subject is granted the right to access and rectify processed data, and may, at any time, withdraw consent for processing and request the erasure of data, by written communication addressed to Lostflavour.

  1. (Data retention period)

Lostflavour will make reasonable efforts to ensure that it retains data about the data subject only for as long as necessary for the purpose for which it was collected, or as required under any contract or applicable law, for a maximum period of 5 (five) years.

  1. (Applicability)

Lostflavour's privacy and personal data protection policies apply to the processing of personal data carried out within the scope of its commercial activities and the provision of its services, in accordance with the principles of lawfulness, fairness and transparency.

  1. (Cookies)

The use of cookies, beacons, plug-ins (extensions) on social networks or any other similar technologies is always communicated in advance to the user, who is given the option of not accepting their use.

  1. (Automated decisions)

No commercial decision will be made based on automated decisions, nor will any action be carried out leading to profiling.

  1. (Supervisory Authority)

The supervisory authority is the National Commission for Data Protection (CNPD), with headquarters at Rua de São Bento nº 148-3º 1200-821 Lisbon;
